SWIMMING POOLS (Residential)
Building Code Guidelines For Residential Pools, Spas and Hot Tubs
Localities in Virginia enforce the regulations established by the Virginia Uniform Statewide Building Code (VUSBC) Section R-326, which mandates that the applicable provisions of the 2018 International Swimming Pool and Spa Code shall be enforced regarding the installation, use and maintenance of all swimming pools, hot tubs and spas for both private and public residential and commercial pools.
PERMITS & FEES
You must obtain a building permit for any pool with a surface area greater than 150 square feet, a capacity over 5,000 gallons or more, or a depth of 24 inches or more. You must also obtain a mechanical or plumbing permit (for fuel-fired heaters) and an electrical permit (for lighting, outlets and filter/circulating equipment). A portable, self-contained spa or hot tub on a slab usually only requires an electrical permit.***Permits are valid for 180 days from the date of issuance.***

WHO SHOULD APPLY FOR THE PERMIT?
Property owners may obtain permits in their own name and perform all work themselves. However, if a contractor is being hired to install the pool, spa, or hot tub, the Building Department recommends the duly licensed contractor obtain the permits as the responsible party so the town can better ensure compliance for defective work.
DOCUMENTS NEEDED
The following documents will be needed for review and issuance of the permit.
1. Plat of the property: Copies may be obtained at the Montgomery County Clerks Office at 55 East Main Street, suit 1, Christiansburg VA.
2. Residential building permit application: Permit may be applied for via our website and is available for download.
3. Construction plans: for (site built pools), Assembly instructions for (above-ground pools), Manufactures specifications for (fiberglass pools, spas, hot tubs).
4. Copy of business license (contractor).
5. Proof of insurance (contractor).
6. Copy of contractors license.
PERMIT PROCESS
1. Submit copy of permit application and other required documents here.
2. Review by town zoning and building departments.
3. Notification of approval.
4. Payment.
5. Permit issuance.
GETTING STARTED
1. Post permit in an area viewable from the street.
2. Identify area where the pool will be located by staking off the boundaries.
3. Request a setback inspection from the town zoning staff. (Permit number required for inspection request).
4. Proceed with construction.

GENERAL REQUIREMENTS
BARRIERS - A permanent fence, wall, building wall, or combination thereof that completely surrounds the pool or spa and obstructs the access to the pool or spa. The term “permanent” shall mean not being able to be removed, lifted, or relocated without the use of a tool.
- No opening in the barrier shall allow the passage of a 4-inch sphere.
- Minimum height shall be 48 inches above grade measured on the outside of the barrier.
- There shall be a clear zone of at least 3 feet between the outside of the barrier and any permanent, climbable structure includes (includes pool pumps, filters, heaters, etc.).
- The inside of the barrier must be at least 20 inches from the water’s edge.
- The clearance from the bottom of the barrier shall be:
- 2 inches or less to grass, gravel or mulch.
- 4 inches or less to concrete, wood or other hard surface.
- 4 inches or less between the top of an above-ground pool and bottom of the barrier when the barrier is installed directly on the above ground pool.
